Rosenberg has no zoning, but the UDC fixes specific building setbacks for accessory dwelling units, multi-family developments, and the SH 36 and US 90A corridors via Sec. 1-430 and Sec. 1-477.
Although the city has no zoning ordinance, UDC Article XVII (Sec. 1-396 through 1-397) requires every permit to comply with setback lines established by plat or by Chapter 4 (Subdivisions). UDC Sec. 1-430 sets accessory dwelling unit setbacks at 50 feet front, 30 feet side and rear, and 10 feet from the main dwelling. Multi-family developments (Sec. 1-251) must provide a 35-foot front building line, 30 to 50-foot interior side lines depending on building height, and 30-foot rear lines. In the SH 36 and US 90A corridors, Sec. 1-477 requires a 25-foot building setback from street rights-of-way and 10 feet from interior property lines. Commercial buildings need a 30-foot setback from adjacent residential uses.
Building inside a required setback line - for example, placing an ADU within 50 feet of the front property line - can result in permit denial, a stop-work order, and a misdemeanor citation under Sec. 1-431.
