In unincorporated Shawnee County, the Zoning Regulations set yard setbacks by district. The rural RA-1 and RR-1 districts, which cover most unincorporated land, require a 30-foot front yard, 7-foot side yard, and 30-foot rear yard on their 3-acre minimum sites.
Shawnee County zones its unincorporated land under the county Zoning Regulations, administered by the Planning Department. In the RA-1 Rural Agriculture and RR-1 Residential Reserve districts, which cover most of the unincorporated county, a detached dwelling must sit on a tract of three acres or more with 200 feet of frontage and keep a 30-foot front yard, a 7-foot side yard, and a 30-foot rear yard (Sec. 2.03). The side yard of a corner lot and the rear yard of a double-frontage lot must meet the 30-foot front-yard figure. Platted R-1 lots follow their own setbacks, and variances go to the Shawnee County Board of Zoning Appeals. The City of Topeka applies its own zoning inside city limits.
Building inside a required yard triggers a stop-work order and correction. Continued zoning violations are enforced by the Shawnee County Planning Department and can bring an order to move or remove the structure plus court penalties.
