Violations & Fines
Building, using or maintaining a structure that does not conform to the district's minimum yard in Table 3.1, or that encroaches beyond the limits set in § 28-24(8), is a zoning violation under § 28-311, and each day the violation continues is a separate offense. The zoning administrator can issue a civil summons carrying a $100 fine for a first offense and $150 for later offenses, capped at $3,000 for violations arising from the same facts, under § 28-314.
