Full Breakdown

Peoria County's Unified Development Ordinance fixes minimum setbacks separately for road frontage, side yards, and rear yards in each zoning district, with the R-1 Low Density Residential District's standards set out at UDO Sec. 2. Side and rear setbacks for "other uses," meaning ordinary houses and accessory buildings rather than telecom or wind-energy facilities, require a principal structure to sit at least 15 feet from a side property line and 25 feet from the rear line, while accessory structures need only 15 feet on either side.

Road setbacks are far larger and depend on the road's classification: a state highway requires 75 feet from the right-of-way (or 135 feet from the road's centerline, whichever is greater) for residential uses, a county primary road requires 75 feet, a county non-primary road requires 40 feet, a collector street requires 40 feet, and a local street requires just 25 feet from the right-of-way. For square corner lots, Sec. 2 treats the road setback as applying to both the front yard containing the main entrance and the side yard facing the right-of-way, with the remaining yards treated as ordinary side setbacks.

No setback lawfully in place on the ordinance's effective date may later be reduced below the current minimum for equivalent new construction, a continuing-obligation rule set out in Sec. 1.

Violations & Fines

Constructing a principal or accessory structure closer to a lot line than the district's minimum setback without an approved variance is a zoning violation subject to enforcement by the Peoria County Planning and Zoning Department, which can deny or revoke a building permit and compel removal or relocation of a noncompliant structure. Property owners must seek a variance from the Zoning Board of Appeals before building within a required setback.

Frequently Asked Questions

How far from my property line must a house sit in Peoria County's R-1 district?
At least 15 feet from a side lot line and 25 feet from the rear lot line for a principal structure, per UDO Sec. 6.5.2. Accessory buildings like a detached garage only need 15 feet from either the side or rear line.
How wide is the road setback for a Peoria County property on a local street?
A local street requires a 25-foot setback from the right-of-way for residential uses under Sec. 6.5.2. State highways require much more, 75 feet from the right-of-way or 135 feet from the road's centerline, whichever distance is greater.
Can Peoria County shrink an existing setback for new construction?
No. Sec. 6.1.1 specifically bars reducing any setback below the current minimum for equivalent new construction, even if the existing setback on the lot is already smaller than what the ordinance requires today.
