Freehold Township, NJ Building Setbacks & Zoning: Structure Height Limits (2026)

Section 190-104 of the Freehold Township Code sets the baseline: no single-family residential structure may exceed 2 1/2 stories or 35 feet, and no building accessory to a residential structure may exceed one story or 16 feet. The ordinance then carves out specific exceptions. Appurtenances attached to principal structures, spires, belfries, domes, antennas, silos, penthouses not for human occupancy, chimneys, ventilators, skylights, water tanks and bulkheads are not counted toward building height so long as they cover no more than 20% of the total roof area, but in residential zones and on properties adjacent to single-family residential zones, any such appurtenance that exceeds the residential height limit by more than five feet must be set back from the property line by a distance equal to its own height.

Freestanding accessories such as water towers, radio and television antennas, windmills and flagpoles are reviewed by the Planning Board for the height necessary to their function and are barred from any required yard setback area. Private residential radio or TV antennas cannot be erected closer to the lot line than the antenna's own height, though a rooftop antenna up to 12 feet is allowed without that setback. Satellite dishes, called personal earth terminals in the code, are limited to the rear yard, capped at 12 feet in height with a 10-foot maximum reflector diameter, and only one per property.

In the M-1 industrial zone, buildings may rise to 75 feet, but anything over 50 feet must sit back 200 feet from front property lines, 125 feet from side and rear lines, and 200 feet from any residential zone. The code enforcement administrator, either the Construction Official or the Zoning Officer, enforces the chapter under Section 190-249 and can order in writing that any violation be corrected.
