Hamilton County, TN Building Setbacks & Zoning: Structure Height Limits (2026)

Zoning Regulations Article IV § 204 sets the residential height ceiling for the R-1 Single-Family Residential District: buildings may not exceed two and one-half stories or 35 feet, except as Articles V and VI provide otherwise. The identical two-and-one-half-story, 35-foot cap appears independently in the A-1 Agricultural District's own § 103 and in several multi-family districts, including § 703 and § 1003, so it functions as the county's default residential height limit even though each district technically restates it. Article VI § 102 carves out specific exceptions: communication towers, penthouses, scenery lofts, cupolas, water tanks, silos, artificial windbreaks, windmills, similar structures and necessary mechanical appurtenances may exceed the district limit, but no space above the allowable height may be used for sleeping, eating, or any commercial purpose beyond what is incidental to the main building's permitted use.

B allows one additional story on the downhill side of the building. Multi-family and high-rise office structures in some districts, such as R-3 Multi-Family under § 703, can seek a height exception from the Hamilton County Board of Zoning Appeals through a special permit rather than a variance.
