Jackson County, GA Building Setbacks & Zoning: Structure Height Limits (2026)

UDC Sec. 123 provides that no building or structure may be erected, constructed, reconstructed, or altered to exceed the maximum height or maximum number of stories established for its zoning district under Article 2, except where another UDC provision specifically allows more. Table 2-2, Dimensional Requirements for Zoning Districts, sets those numbers. Every one of the county's residential districts, PCFD, A-1, A-2, A-3, AR, R-1, R-2, R-3, and MH, tops out at 35 feet and three stories, while NRC is also capped at 35 feet but limited to two stories.

The commercial and industrial tiers allow taller construction: CRC is capped at 50 feet and four stories, HRC at 50 feet and five stories, and LI, GI, and HI at 50 feet and four stories each. Sec. 124 exempts certain structures from these height caps altogether, including agricultural buildings such as barns, silos, windmills, and grain elevators (but not dwellings); cooling towers, gas holders, and other industrial structures required for a manufacturing process; and church spires, belfries, cupolas, domes, monuments, water towers, observation towers, chimneys, smokestacks, flag poles, non-commercial radio and television towers and antennas, electricity transmission towers, and utility poles.

A building that exceeds the applicable height cap and does not fall under one of these exceptions becomes a nonconforming structure under UDC Sec. 131, and any later expansion must meet the district's current height limit under Sec. 137.
