Violations & Fines
Constructing, altering, or maintaining a structure that exceeds the applicable district's maximum height is a zoning violation under Section 24-6-101, allowing the building inspector to institute proceedings to prevent, restrain, or abate the violation, with the police department authorized to assist. Section 24-6-102 makes each such violation a misdemeanor punishable by a fine of not less than $10.00 and not more than $250.00, or up to 30 days in jail, or both, for each day the violation continues, with an alternative or additional administrative citation carrying civil fines up to $500.00 per offense count under Chapter 2, Article IX of the Code.
