Because Elkhart County exercises zoning authority through its Area Plan Commission under Indiana's Advisory Planning Law (IC 36-7-4), height caps in the unincorporated county are enforceable rules, not guidelines. In residential districts including R-1 Single-Family, the base maximum height for a detached single- or two-family dwelling is 30 feet. Section 4.3.10(B) allows that height to increase above 30 feet but no higher than 40 feet, if two side yards of at least 15 feet each are provided. Height is measured from the highest adjacent curb elevation, or from average finished grade when the building is set back. Spires, chimneys, and water towers are exempt.
Exceeding the height cap violates the Elkhart County Zoning Ordinance. Planning and Development can withhold the permit and require the structure be lowered. Greater height needs a variance from the Board of Zoning Appeals.
