Indiana adopts a uniform statewide building code under IC 22-12 and IC 22-13 that local governments cannot weaken. Structure height limits in zoning are local, but building height construction standards follow the state code.
Under IC 22-13-2-2, the Fire Prevention and Building Safety Commission adopts building rules that have statewide application. Locally adopted construction codes that conflict with the state code are void under IC 22-13-2-9. The Indiana Building Code (675 IAC 13) and Indiana Residential Code (675 IAC 14) set construction-based height categories, fire-resistive ratings, and structural requirements that scale with stories and feet. Municipalities and counties may add zoning height limits and aesthetic regulations under IC 36-7-4 but cannot lower construction-safety requirements set by the Commission. State Building Commissioner interpretations bind localities when published in the Indiana Register.
Construction not meeting state code may be denied a Certificate of Occupancy. Building without permits or to weakened local standards is unenforceable; the state code controls.
