Summary

Collier County's Land Development Code caps principal building height district by district in Table 2 of LDC 4.02.01 A: 35 feet in the GC, A, RSF and RMF-6 districts, 30 feet in Estates, 50 feet in RMF-12, 75 feet in RMF-16, and 10 stories not to exceed 100 feet in RT. Rooftop equipment is exempt, and the County Manager can waive height for structured parking.

These county ordinances apply to unincorporated areas of Collier County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

Table 2 of LDC section 4.02.01 A sets the maximum building height, in feet, for principal uses in each base zoning district. The A, GC, RSF-1 through RSF-6 and RMF-6 districts are all capped at 35 feet, while Estates (E) is lower at 30 feet. Height climbs with density: RMF-12 allows 50 feet and RMF-16 allows 75 feet. The RT district is measured in stories instead, 10 stories not to exceed 100 feet. In the VR district the cap is 30 feet for single-family, mobile home and duplex buildings and 35 feet for multi-family. MH and TTRVC are 30 feet.

Commercial and industrial districts follow their own steps. C-1, C-2 and C-5 are 35 feet, C-3 is 50 feet and C-4 is 75 feet. The I district is 50 feet, BP is 35 feet and CON is 35 feet. In CF, towers and antennas are limited to 40 feet and every other building to 30 feet. The P district prints no number. Footnote C instead limits a building within 100 feet of an adjoining district to the height of the most restrictive adjoining district. Properties in an overlay district look to a separate table of special design requirements, so Table 2 alone does not settle their height.

Taller buildings also have to be spaced apart. Footnote A requires 50% of the sum of the heights of the buildings, but not less than 15 feet, between buildings in RMF-6, RMF-12, RMF-16, RT, C-2, C-4, C-5, I and BP. CF uses footnote D, the same 50% formula with a 25 foot floor.

Section 4.02.01 D.1 exempts rooftop infrastructure from Table 2: mechanical penthouses, elevator and stair shafts, mechanical equipment and screening, spires, belfries, cupolas, flagpoles, antennas, wireless communication facilities, water tanks, ventilators, chimneys, silos, windmills and airport control towers, as long as they are not intended for human occupancy or commercial purposes. Four conditions apply: each element can be no higher than necessary for its purpose, the combined area of these structures cannot exceed one-third of the supporting roof, section 5.05.08 controls where it conflicts, and FAA and airport zoning limits in the flight approach zone still govern (LDC 2.03.07 C).

Section 4.02.01 D.2 lets the County Manager or designee waive the maximum height where off-street parking is built inside the principal structure. The required parking count cannot drop, the waiver cannot exceed what the parking needs, with a maximum of two parking levels, it must be compatible with adjacent uses, and 300 square feet of extra open space is required for each parking space the waiver allows. Section 4.02.02 sets separate figures for conditional and accessory uses: conditional uses in RT stop at 125 feet, VR is capped at 50 feet with no more than three levels of habitable space, and accessory uses in MH stop at 20 feet.

Violations & Fines

The sections quoted here print no fine schedule of their own. Height is enforced through Collier County's site development plan and building permit review under the Land Development Code, and a building taller than its Table 2 figure is nonconforming unless an exemption or waiver covers it. The rooftop exemption is lost if an appurtenance is taller than its function requires, covers more than one-third of the roof, is built for human occupancy or commercial use, or breaches FAA or airport zoning limits. A parking waiver is lost if the number of required spaces is cut or the extra open space is not provided.

Frequently Asked Questions

How tall can a house be in Collier County?
In RSF-1 through RSF-6 the maximum building height in Table 2 of LDC 4.02.01 A is 35 feet. Estates (E) is stricter at 30 feet, and the A district is 35 feet. In VR, single-family, mobile home and duplex buildings are limited to 30 feet, while multi-family buildings can reach 35 feet.
Do chimneys, antennas and rooftop equipment count toward the height limit?
No, if they qualify under LDC 4.02.01 D.1. Chimneys, antennas, flagpoles, mechanical equipment, elevator shafts and similar appurtenances above the roof are exempt when not intended for human occupancy or commercial purposes. They must be no higher than necessary, and together they cannot cover more than one-third of the supporting roof area.
Can Collier County waive the height limit for a parking garage inside a building?
Yes. The County Manager or designee can waive the maximum height under LDC 4.02.01 D.2 when parking is built within the principal structure. The waiver is limited to two parking levels, cannot reduce required spaces, must be compatible with adjacent uses, and requires 300 square feet of extra open space for each space permitted.
How tall can apartments and hotels be?
RMF-6 is capped at 35 feet, RMF-12 at 50 feet and RMF-16 at 75 feet. RT is limited to 10 stories, not to exceed 100 feet, and conditional uses in RT reach 125 feet under LDC 4.02.02 D. Commercial C-4 allows 75 feet. These buildings also need spacing of 50% of the sum of building heights, at least 15 feet.
Do overlay districts change the height limit?
Table 2 lists overlay districts without a number and directs the reader to the table of special design requirements applicable to overlay districts. A parcel inside an overlay therefore needs that separate table, not only the base district figure, to find its height cap.
