No person shall cause or permit the establishment of a sexually-oriented business within 1,000 feet of another such business or within 2,500 feet of any religious institution, school, boys' club, girls' club or similar existing youth organization, or public park or public building, or within 2,500 feet of any property zoned for residential use or within 1,000 feet of any property used for residential purposes.

Operating a sexually-oriented business without a valid county permit is a misdemeanor under § 114.09(A) and § 114.26, punishable under § 114.99 by a fine up to $300 and/or up to 30 days in the county jail, with each day of continued violation charged as a separate offense. The county may also seek an injunction against unpermitted operation (§ 114.07) and can recover attorneys' fees and costs in any enforcement action (§ 114.99(B)).
