Full Breakdown

Article VIII of chapter 12 regulates sexually oriented businesses across the unincorporated parish. Sec. 12-250(a) bans locating one within 2,500 feet of a public park or library, a nonprofit educational museum, a bona fide church or synagogue, a public or private elementary or secondary school, a day care center or kindergarten, another sexually oriented business, or a structure containing another such business; Sec. 12-250(b) adds the same 2,500-foot buffer around a residential subdivision or a building site devoted to residential use. Sec. 12-251 measures those buffers in a straight line, without regard to intervening structures, from the nearest wall of the sexually oriented business to the nearest property line of the protected use, or, between two sexually oriented businesses, from exterior wall to exterior wall.

Sec. 12-252 requires an operator to apply to the parish administrator before opening, disclosing the exact nature of the business and the sexual activities to be conducted, plus any location, ownership, and employee information the administrator finds pertinent, including arrest and conviction history. Permits run from January 1 each year, renewal applications are due by November 1, and each application carries a nonrefundable fee set by the parish commission. The administrator must approve or deny within 30 days and, on denial, must give written reasons within 15 days; an applicant may appeal to the parish commission within 30 days of receiving that denial, and the commission's decision is final subject to judicial review.

Violations & Fines

Sec. 12-249 makes any violation of the sexually oriented business article punishable by a fine of up to $500.00, up to 30 days in the parish jail, or both, with each day the violation continues counted as a separate offense. The parish commission or any specifically damaged neighboring property owner may also seek an injunction, mandamus, or other court action to stop or correct an unlawful sexually oriented business use.

Frequently Asked Questions

How far must a sexually oriented business be from a school or church in Caddo Parish?
At least 2,500 feet. Sec. 12-250 bars operating within that distance of a public park or library, a museum, a church or synagogue, a school, a day care or kindergarten, another sexually oriented business, or a residential subdivision, measured straight-line from the nearest wall under Sec. 12-251.
Who issues the sexually oriented business permit in Caddo Parish?
The parish administrator issues it under Sec. 12-252, after the applicant discloses the business's exact nature, the sexual activities conducted there, and ownership and employee information the administrator deems pertinent, including arrest and conviction history. Permits run on a calendar year and must be renewed by November 1 each year.
Can a denied sexually oriented business permit be appealed?
Yes. Sec. 12-252(e) lets an applicant appeal a denial to the parish commission within 30 days of receiving the administrator's written reasons, and the commission's decision after a hearing is final, subject to any applicable legal processes available to the applicant.
