44, Sex-Oriented Businesses, adopted by Ordinance No. 040(a) for anyone to operate, engage in, conduct, or carry on a sex-oriented business in the city unless the owner first obtains and maintains a sex-oriented business permit. 040(c) requires a nonrefundable processing fee, a notarized statement from the property owner and any sublessor acknowledging the business is sex-oriented, a dimensional site plan, and sworn attestations under penalty of perjury; an owner whose permit was revoked cannot reapply for three years. 050(b) sets the spacing standards the chief of police must confirm before issuing a permit: the business must sit in a zone that permits sex-oriented uses, and cannot be located within 500 feet of any existing residence, within 500 feet of another sex-oriented business under different ownership, within 1,000 feet of any religious institution, public park, or school, or partly or wholly within a portable structure.
