Code Sec. 8-48 makes it an offense to operate a sexually oriented business, including adult arcades, adult bookstores or video stores, adult cabarets, adult motels, adult theaters, escort agencies, nude model studios, and sexual encounter centers, without a valid license issued by the city for that specific type of business. The chief of police reviews applications under Sec. 8-52 and must issue a license within 30 days unless disqualifying factors apply, such as an unpaid license fee, falsified application information, a disqualifying criminal conviction within the lookback periods set by the section, or being under 18.

Location is separately restricted under Sec. 8-81: it is an offense to operate such a business within 1,000 feet of a church or church-related structure, a public or private school or school zone, the boundary of a residential or historical district, a public park, playground, library, day care center, or the property line of a residential lot, and it is likewise an offense to operate within 1,000 feet of another sexually oriented business, or to co-locate more than one such business in the same building.

Sec. 8-82 measures that 1,000 feet in a straight line without regard to intervening structures, from the nearest building wall to the nearest affected property line or district boundary. An operator denied on locational grounds may request an exemption from the board of adjustment within ten days under Sec. 8-84, and the board decides by supermajority vote after a hearing.
