Section 88.0715 measures distance in a straight line, without regard to the boundaries of the city and to intervening structures. Between businesses it runs from the closest point of each business. For residential uses, religious institutions, schools and parks it runs from the nearest portion of the property line of the lot where the business is conducted to the nearest property line of the protected use.
A city license is also required. Section 83.0301220 makes it unlawful to carry on a regulated sexually-oriented business without a valid license for each business, and live performers need an entertainer license. Under § 83.0301225 a separate license is required for each location and must be displayed prominently. Section 83.0301240 makes the license valid for one year, with renewal applications due at least thirty days before expiration. Under § 83.0301245 the application is filed on a form provided by the police chief with a non-refundable fee set by city council resolution. Transfer of ownership or control, or a change of location or name, voids the license immediately (§§ 83.0301230 and 83.0301235).
Under § 88.0720, operating more than one sexually-oriented business in the same building, or a sex supermarket or sex mini-mall, is also a misdemeanor. Under § 88.0735(c), discontinuing the use for one hundred and eighty days ends legal nonconforming status.
Violations & Fines
Under § 88.0725, any person violating the chapter is guilty of a misdemeanor punishable by a fine of not more than $1,000, imprisonment for not more than six months, or both, and each day is a separate offense. Section 88.0720 makes establishing or operating outside the IC district, or inside the locational standards, a misdemeanor.
