Fulton County, GA Business Licensing & Operations: Auto Repair on Residential Property (2026)

Zoning Resolution § 4.12 allows a home occupation as an accessory use of a dwelling in any zoning district, limited to the resident family, but subsection D carves out a list of uses that can never qualify no matter how small the operation: auto repair or similar operations, restaurants, keeping of animals, funeral homes, retail or wholesale shops, motel-type establishments, taxi services, or any other use the county finds incompatible with the resolution's intent. That last catch-all phrase means the Department of Environment and Community Development can add uses to the exclusion list case by case even though they are not spelled out by name.

Because auto repair is excluded at the definitional level, it is not a home occupation that can seek a variance or use permit under § 4.12; the fix in the code is to locate the repair business in a zoning district that permits automotive repair as a principal or conditional use. The other subsections of § 4.12 reinforce why: a home occupation cannot use an accessory building (§ 4.12.B), cannot keep on-site vehicles for anything but resident use (§ 4.12.H), cannot bring in goods by truck (§ 4.12.I), and cannot run equipment or machinery whose sound carries beyond the unit (§ 4.12.J), restrictions a working auto repair bay would routinely break.

This is a county zoning rule and applies only to unincorporated Fulton County. Auto repair operated from a home inside Atlanta, Sandy Springs, Johns Creek, Milton, Chattahoochee Hills or South Fulton is governed by that city's own zoning code instead.
