Newton County, GA Business Licensing & Operations: Massage Establishments (2026)

Operating a massage establishment or spa establishment anywhere in unincorporated Newton County requires a massage/spa establishment license under section 12-46(a), on top of the separate occupation tax certificate required by article VII of chapter 44. The license application is filed in person at the county development services department, must be executed and notarized by the person primarily responsible for operating the business, plus an officer, member, partner, or shareholder if the applicant is an entity, and is not considered complete until it is accompanied by the annual regulatory fee and detailed disclosures: the applicant's legal names used in the past five years, lawful-presence and work-authorization affidavits, a state-license copy or certification for anyone offering licensed massage services, and, for entities, a list of officers, directors, and owners holding a ten percent or greater interest.

Under section 12-46(d), the development services director runs a criminal background investigation on the applicant and must either issue the license or issue a written denial within 60 days of a completed filing; a license is denied to an applicant under 21, one who lacks a valid ownership or lease interest in the premises, or one connected to a prior nuisance finding or revoked license within the past five years, among other grounds. Section 12-47 sets the license to expire every December 31, with a required renewal filing by November 1 and a ten percent late fee after that date; licenses are not transferable. Section 12-48 separately requires every massage/spa employee to hold an individual work permit, issued or denied within 15 days of a completed application.
