SECONDHAND DEALER. A person that engages in SECONDHAND DEALER transactions. Chapter 112 of the Carroll County Code of Ordinances regulates secondhand dealer establishments across the unincorporated county. 02 defines a SECONDHAND DEALER as anyone who receives tangible personal property and offers it to the public for sale, trade, or barter, but the definition carves out a charitable, religious, or nonprofit organization where the exchange is incidental to its main activity, an antique show, trade show, convention, or auction, a flea market, a retailer of new and unused video game products, and an antique dealer. 05 requires a signed record of every item received: the date, time, and place, a comprehensive description including visible identification marks, model and serial numbers, and whether the item looks new or is in its original packaging, the consideration paid, and the seller's identifying information, including a driver's license number or two forms of ID plus a physical description.

Violations & Fines
Section 112.99 authorizes the County Attorney or the appropriate law enforcement agency to seek civil penalties of up to $1,000 per day for each day a violation continues, in addition to an action for injunction or other equitable relief. A criminal violation of the chapter is a misdemeanor punishable by a fine of up to $1,000, imprisonment up to six months, or both.
