Anaheim tobacco retailers must hold a state CDTFA tobacco license and a city business license. California's flavored tobacco ban (SB 793) applies, prohibiting flavored products including most flavored vapes citywide.
California requires all tobacco retailers to hold a state license issued by the California Department of Tax and Fee Administration (CDTFA) under Business and Professions Code 22972. Anaheim does not currently impose a separate tobacco retail license beyond the standard business license. SB 793, upheld by voters as Proposition 31 in 2022, bans the sale of most flavored tobacco products including flavored e-cigarettes, menthol cigarettes, and flavored cigars. Federal Tobacco 21 sets the minimum sales age at 21. Retailers within 1,000 feet of schools face additional state restrictions on placement and advertising.
Selling flavored tobacco or to minors triggers state CDTFA penalties up to $5,000 per violation, license suspension, and city business license revocation; criminal misdemeanor charges may also apply.
