54 of the Zoning and Subdivision Ordinance applies to every smoke or tobacco shop citywide, defined as any premises dedicated to displaying, selling, distributing, delivering, or offering tobacco, tobacco products, or tobacco paraphernalia, carving out grocery stores, supermarkets, and convenience stores where tobacco sales take up 10% or less of floor area as an accessory use. " Beyond that, the section layers two 1,000-foot buffers measured in a straight line between property lines: one from any hospital or "youth-populated area" (schools, licensed child-care facilities, public libraries, playgrounds, youth centers, recreational facilities, and public parks), and a second concentration limit keeping new shops 1,000 feet from an existing smoke or tobacco shop.

Operationally, no smoking is permitted on the premises at any time, no more than 20% of window area may be obscured, and interior lighting must stay bright enough during business hours to keep shop operations visible from outside. Every public entrance must display signage stating minors may not enter unless accompanied by a parent or legal guardian, and failing to display or maintain that signage is itself declared unlawful. Existing nonconforming shops that predate the April 2025 ordinance (No. 4332) may continue operating but lose that status permanently once abandoned, discontinued, or converted to a conforming use, per the cross-referenced nonconforming-use rules in Chapter 236.
