Section 230-11 defines SMOKE SHOP as a retail establishment that specializes in the sale of smoking-related products and accessories, including CBD products, vape devices and e-liquids, cigars, tobacco products, and smoking paraphernalia such as pipes, rolling papers and hookahs, plus related vaping and tobacco replacement parts. Rather than allowing that use by right or through Planning Board site-plan review, Section 230-16 lists 'Smoke shops' only under 'Town Board special permit approval and optional advisory referral to the Planning Board' in the NC-1 Neighborhood Commercial District, the HC-1 Highway Commercial District, and the RC-1 Regional Commercial District.

No Commercial district allows a smoke shop through a building permit alone. Under the Town-wide special permit standards of Section 230-27, an applicant must file with the Department of Planning and Development, go through a public hearing, and satisfy general findings that the use will not be injurious to the neighborhood or otherwise detrimental to the public welfare, along with conformance-to-planning, scale, circulation, aesthetics and emissions criteria. The Town Board may impose conditions on approval, and the permit is voided if a building permit is not issued within twelve months of approval, extendable up to two additional twelve-month periods by the Commissioner of Planning and Development.

Because the Town Board, not staff, decides each application at a public hearing, approval is discretionary and can be denied case by case even where the underlying zoning district otherwise permits retail use generally.
