Chapter 453, Article I, adopted December 14, 2022 by Local Law No. 18-2022, defines "specified tobacco products" to include tobacco heating systems, e-cigarettes, electronic nicotine delivery systems, vaping products and synthetic nicotine products, excluding items available only by pharmacy prescription. Section 453-2A bars selling or offering to sell those products within 750 feet of a qualifying school or public park, while § 453-2B sets a wider 1,500-foot buffer for advertising or display. Section 453-2C fixes the measuring method: a straight line from the nearest property line of the school or park to the building where the sale, display or advertising occurs, not to the retailer's lot line.

A grandfather clause in § 453-3C lets a business that was lawfully selling these products on the law's effective date continue selling for one year after the local law was filed with the New York Secretary of State before it must stop. The chapter splits enforcement: the Police Department and Building Inspector enforce the 750-foot sales ban under § 453-3A, and the same two offices enforce the 1,500-foot advertising and display ban under § 453-3B, each carrying its own separate fine schedule. The Office of the Town Attorney can also seek closure of a business "for good cause shown" if it keeps violating the article, on top of any misdemeanor conviction.
