Full Breakdown

040 makes it a misdemeanor to act as a tobacco retailer in Lancaster, defined broadly enough to cover cigarettes, cigars, chewing tobacco and vapes, without first getting a tobacco retailer's license for each location, and bars peripatetic sales or sales from a vehicle. 050 must include proof the location already holds a valid California Board of Equalization tobacco retailer's license and a disclosure of any prior violations of the chapter within the past six years. 060 lets the city manager deny a license only for an incomplete application, a pending suspension, or a location that is otherwise unlawful under state or federal law, and requires renewal notices to go out by November 1st each year.

Compliance is monitored by the sheriff's department, the business license department, and code enforcement, who aim to check every retailer at least twice per twelve-month period (Sec. 110). 42 separately classifies 'Tobacco Retail,' a category that expressly includes vapes, as requiring at minimum a Minor Use Permit from the Community Development Director in the MU, C, CPD, LI and HI zones, with a Conditional Use Permit possible at the director's discretion (Sec. 030). 040: 1,000 feet from a K-12 public or private school, 300 feet from a religious assembly, day care center, or residential use, and 500 feet from an existing alcoholic beverage establishment, public park, or hospital, measured in a straight line between the closest property lines.

Violations & Fines

Selling tobacco or vape products without a current license, or in violation of any local, state or federal tobacco law, is a misdemeanor and can trigger license suspension of up to 30 days for a first violation, 90 days for a second within five years, and revocation for a third (Sec. 5.42.120). The city attorney can also pursue abatement as a public nuisance, and a licensee may appeal any denial, suspension or revocation to the city council under Chapter 2.44.

Frequently Asked Questions

Does a vape shop need a special license in Lancaster?
Yes. Chapter 17.42's definition of 'Tobacco Retail' expressly covers vapes alongside cigarettes and cigars, and any business selling them needs both the tobacco retailer's license required by Section 5.42.040 and, for the zoning side, at least a Minor Use Permit from the Community Development Director under Section 17.42.030.
How far must a Lancaster tobacco or vape shop be from a school?
Section 17.42.040 requires 1,000 feet of separation from any K-12 public or private school for a tobacco retail or smoking lounge use that needs a use permit, along with 300 feet from religious assembly, day care and residential uses, and 500 feet from an existing alcoholic beverage establishment, public park or hospital, measured property line to property line.
What happens if a Lancaster tobacco retailer sells to a minor?
Section 5.42.120 lets the city suspend the license up to 30 days for a first violation of the chapter's conditions, up to 90 days for a second violation within five years, and revoke it for a third violation, after notice and an opportunity to be heard, with a right to appeal to the city council.
