No person shall sell tobacco products or electronic smoking devices unless the person is authorized to do so by a license issued by the Department, or is an employee or agent of a person who has been issued a license by the Department. Following the date on which this section becomes effective, no licenses will be issued to persons selling tobacco products within one thousand (1,000) feet of school property as measured by a straight line from the nearest point of the property line of the parcel on which the school property is located to the nearest point of the property line of the parcel on which the person's business is located. ... 2.i.The annual license fee for the retail sale of tobacco products is as follows:a.One hundred twenty-five ($125.00) for each retail establishment where tobacco products are sold other than by vending machine. A separate license shall be required for each such retail establishment;b.Twenty-five dollars ($25.00) for each vending machine which dispenses tobacco products or electronic smoking devices. ... ii.The annual license fee for the retail sale of electronic smoking devices shall be twenty-five dollars ($25.00).

Violations & Fines

Selling without a license, or violating §§ 602.362 through 602.367, draws a fine of at least $500 for a first offense, $750 for a second within three years, and $1,000 for any later offense. Selling in violation of § 602.361's license or school-zone rule carries a fine of $500 to $1,000 under § 602.370(4), and a free-sample violation carries a minimum $500 fine. The Department of Public Health may also issue an administrative citation under § 602.371 assessing the maximum statutory fine directly.

Frequently Asked Questions

Do vape shops need a separate license from tobacco stores in St. Louis County?
Yes and no: a store selling only electronic smoking devices can get the $25-a-year e-cig-only license under § 602.361.2.ii, but any store also selling cigarettes, cigars, chewing tobacco or other tobacco products needs the $125 retail tobacco license under § 602.361.2.i, and each retail location needs its own license.
Can a new vape or tobacco shop open near a school?
Not for tobacco products: § 602.361 bars new tobacco licenses within 1,000 feet of any public or private school, preschool or Special School District building, measured property line to property line. Existing license holders at that address before the ban, or businesses licensed there in the prior 24 months, are exempt.
