Full Breakdown
San Jacinto regulates tobacco and vape sales in two places. Chapter 5.56 is the licensing rule. Section 5.56.040(A) makes it unlawful to act as a tobacco retailer without a valid tobacco retailer's license for each location, and retailing without one is a public nuisance. Section 5.56.030 defines "tobacco product" to include any product containing biologically active amounts of nicotine that is sold with the expectation that it will be introduced into the human body, so nicotine vape and e-cigarette products fall inside the definition, with an exception for products approved by the FDA to treat dependence. The application proves the location holds a California Board of Equalization retailer's license. Under Section 5.56.050, no license can issue for other than a fixed location, so sales on foot or from vehicles are prohibited. The term is one year, renewal is due no later than thirty (30) days before expiration, and the license cannot be transferred (Sections 5.56.060 and 5.56.070). The city monitors compliance at least three times per twelve-month period.
Section 17.430.340 of the Development Code is the zoning rule. Subsection (C) prohibits head shops and smoking lounges outright. Under subsection (D), a tobacco store, meaning a business with 15% or more of its square footage used for tobacco products or paraphernalia, needs a conditional use permit under Chapter 17.605 for creation or substantial enlargement. The application has to show a valid state license and a Riverside County tobacco retailer's license for every person with an ownership or managerial interest. Under subsection (F), the review authority has to find the store is in the CG or CR zones and 1,000 feet, property line to property line, from other tobacco retailers, schools, child care centers, parks, libraries, places of worship and residentially zoned property. Subsection (G) attaches conditions: ID checks for buyers who reasonably appear under 27, no self-service displays or vending machines, no smoking on the premises, no more than 10% of floor area or eight square feet of shelf space for tobacco paraphernalia, and sales only in original packaging.
Violations & Fines
Violations of Chapter 5.56 are public nuisances. The city attorney or district attorney can seek civil fines of $250 to $1,000 for a first violation in sixty months, $1,500 to $2,500 for a second, and $3,000 to $10,000 for a third or later, or prosecute as an infraction or misdemeanor. Licenses are revoked for violations, with waiting periods before relicensing a location, and sales without a license can bar a proprietor for 30 days, 90 days or five years.
