Table 2-91.1 in Sec. 2-91 of the Land Development Code lists 'Tobacco, Hookah, and Vapor Retail Store' as a defined retail use, 'a shop or tobacco bar that specializes in the sale or consumption of tobacco, cigars, cigarettes, electronic cigarettes, electronic vapor devices, hookahs, or other tobacco products,' but every district column next to it, B-O, B-1, B-2, M-1, M-2 and BR, is left blank. The table's key states plainly that a 'Blank Box = Prohibited Use,' so under the standard zoning ordinance the use is banned citywide; the entry itself cross-references 'the Code of Ordinances for additional Smoking Regulations' instead of granting a district.

That separate Code of Ordinances article, Sec. 3-139 through Sec. 3-144 (Smoking in Public Places), regulates the two carve-out business types that can sell tobacco for on-site use: a 'Retail tobacco store' is defined as an establishment deriving 'at least 60 percent of its gross revenues... from the sale of tobacco products and smoking accessories,' and a 'Tobacco bar' is one where on-site tobacco sales exceed 20 percent of gross revenue and entry is restricted to patrons 21 and older. Under Sec. 3-142, smoking is allowed in tobacco bars only if they were 'in operation on or before December 31, 2023,' meaning no new tobacco bar can legally permit on-site smoking. Owners of any establishment where smoking is prohibited must post 'No Smoking' signage under Sec. 3-143, and Sec. 3-144 makes noncompliance an offense. Because Table 2-91.1 gives the retail use itself no by-right or conditional path in any standard district, a new freestanding vape or tobacco retailer needs a Planned Development District rezoning approved by City Council to locate in Sugar Land at all.
