Woodbridge, NJ Business Licensing & Operations: Tobacco Retail License (2026)

Woodbridge Code § 35-14.3 requires any establishment that sells electronic smoking devices, defined at § 35-14.2 as electronic cigarettes, cigars, cigarillos, pipes or any other powered device delivering nicotine or other substances by inhalation, to obtain a license from the Department of Health and Human Services before conducting, maintaining or operating that business. The Electronic Smoking Device Establishment License costs $1,350 and, per § 35-14.3(c), expires annually on December 31 regardless of when in the year it was issued.

New licensees don't pay the full annual fee if they start mid-year: § 35-14.3(d) prorates the fee to the months remaining in the license year, including the month of issuance, so a business licensed in July owes $450 for its first six months. Licenses cannot be transferred by sale or otherwise, and an itinerant establishment must keep its license readily available for display rather than posted, while a fixed location must post it conspicuously.

Under § 35-14.4, an applicant files a written application with the Department along with the correct fee, and the Department processes it and issues the license within 14 days, listing the establishment's name, address and the license's effective dates. Purpose language in § 35-14.1 explains that the licensing fees fund a Tobacco Age of Sale Enforcement Program plus other smoking cessation, prevention and control programs, and § 35-14.5 puts enforcement with the Department of Health and Human Services and other municipal officials, who can order an immediate stop to sales upon finding a violation.
