Summary

Howard County caps what a trespass towing service can charge to tow a vehicle from private property without the owner's consent: separate maximum rates for attaching, towing by distance, and 12-hour storage blocks, all set annually by County Council resolution. Every towing service must register with the Office of Consumer Protection and file its rates, and violations can draw a $1,000 civil fine per offense.

These county ordinances apply to unincorporated areas of Howard County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)When towing a vehicle from private property without the consent of the vehicle owner, a towing service shall not charge more than maximum rates which are set annually by resolution of the County Council.(b)Fair and reasonable maximum rates shall be set for each of the following acts:(1)Attaching the vehicle to be towed to the tow truck.(2)Towing the vehicle to a storage site. This rate shall be based on the distance the vehicle is towed.(3)Storing the vehicle. This rate shall be based on 12-hour time periods during which the vehicle remains in the custody of the towing service. ... Each trespass towing service shall be registered with the Office of Consumer Protection and shall pay annually in January a registration fee recommended by the Consumer Protection Administrator and which is set annually by resolution of the County Council.

Full Breakdown

Title 17, Subtitle 6 of the Howard County Code regulates trespass towing, meaning the towing of a vehicle from private property without the owner's consent; it doesn't authorize towing on its own, since the underlying authority to remove a vehicle has to come from another statute or the common law, and this subtitle only restricts how that authority is exercised. 601, a towing service can charge no more than the maximum rates the County Council sets each year by resolution for attaching a vehicle to the tow truck, towing it to storage (billed by distance), and storing it in 12-hour blocks, with no charge accruing until at least six hours have passed.

602 requires every trespass towing service to register with the Office of Consumer Protection, pay an annual January registration fee, file its rate schedule, and keep a signed contract on file with each property owner it tows for. 603 requires the property owner to post signs at least 24 hours in advance listing the towing company, its phone number, the maximum charge, and the Office of Consumer Protection's number, unless the property is residential and the owner instead tags the offending vehicle. 607 for no more than half the attachment fee. 602(g)-(i).

Violations & Fines

The Office of Consumer Protection can seek a civil fine of up to $1,000 per violation of this subtitle, or enforce it as a Class A civil offense under Howard County Code § 17.611, with each day a violation continues counting as a separate offense. A towing service that overcharges, tows without a signed contract or tow slip, or fails to post the required signage also risks having its County registration revoked.

Frequently Asked Questions

Can a Howard County towing company charge whatever it wants?
No. Howard County Code § 17.601 caps trespass towing rates at maximums the County Council sets annually by resolution, covering attachment, distance-based towing, and 12-hour storage increments. A towing service also can't charge for any service the vehicle owner didn't request, and it must file its rates with the Office of Consumer Protection.
How do I get my car back after a non-consent tow?
Trespass towing services must keep redemption areas open 24 hours a day, seven days a week under § 17.608, and must accept cash plus at least a credit card or personal check. If you return before the tow is finished, § 17.607 caps the release fee at half the attachment charge.
What happens if a towing company violates Howard County's towing law?
The Office of Consumer Protection can seek a civil fine of up to $1,000 per violation, treat it as a Class A civil offense under § 17.611, or revoke the company's registration, subject to the operator's right to a hearing and appeal to the Board of Appeals.
