Chapter 58, Article I sets two overlapping regimes. Under Sec. § 44-1-13 is adopted by reference to govern the removal itself. Sec. 58-7 then regulates every nonconsensual towing carrier that uses city streets, on top of whatever the Georgia Public Service Commission already requires. Wreckers must carry the owning company's name, operating address and phone number lettered on each side in a contrasting color at least two and one-half inches tall, permanently affixed; magnetic signs are banned outright. When a wrecker is called by someone other than an on-duty officer, the driver must electronically report the removal, release and storage location, plus the vehicle description, VIN and tag number, to the police department within one hour of depositing the vehicle and within 24 hours of releasing it to the owner.
Impound lots must log the date and time the tow call was received, the caller's name, the times of towing and arrival at the lot, the release date and time, and the names of the driver and helper, all available to the public electronically, by phone or in person during normal business hours. Every wrecker service, public or private, must also register the current release-contact phone number with police, employ a check approval agency, and accept major credit cards (Visa, MasterCard, American Express and Discover) for towing and storage fees; refusing insured checks or major cards is itself unlawful.
