Blue Earth County, MN Cannabis Regulations: Buffer Zones (2026)

Blue Earth County built its cannabis buffer rule directly into Sec. 24-341(b), measuring every distance from the edge of the cannabis business's operational area to the property line of the protected use, with the planning agency confirming the measurement. A 1,000-foot buffer applies around schools alone; every other protected use carries a 500-foot buffer, including a licensed daycare, a residential treatment facility, a public park regularly used by minors such as a playground or athletic field, a church or house of worship, a residential dwelling, and even another cannabis business.

The stated purpose, spelled out right after the list, is to limit nuisance conditions such as odor rather than to ban the use outright. The county also built in a grandfathering protection: if an active cannabis business or one seeking registration is already operating and a school, daycare, residential treatment facility, or minors' park attraction later moves within the buffer distance, the cannabis business does not have to close. It instead becomes a legal nonconforming use and continues under the applicable nonconforming-use standards of the county ordinance rather than being forced out by the new neighbor.

These buffers apply on top of the zoning-district limits in Sec. 24-341(c), which confine retail to the General Business and Highway Business districts and cultivation, manufacturing, wholesale, transport and delivery to the Light and Heavy Industry districts, and on top of the site inspection and interim use permit process required before a cannabis business can open under Sec. 24-341(a).
