Full Breakdown

Section 550-143 of the Land Development chapter, first adopted in 2021 and last amended January 21, 2025, layers three separate distance rules onto every cannabis establishment, delivery service, medical cannabis establishment and dispensary. ' A second, separate 250-foot radius runs from the exterior wall of the cannabis premises to the exterior wall of a school, recreation center, child-care establishment or house of worship, or to the property line of a playground or park, and this one is measured as a straight-line radius rather than a walking route.

Operators must also erect physical barriers to block sight lines to all of those protected uses. C makes the municipal permit or license subject to annual renewal through Township Council approval. A class 5 retail establishment carries an added 1,300-foot separation, walking distance, from any other Hamilton class 5 retailer. Cannabis establishments and delivery services are barred outright from operating as a home occupation or out of a live/work unit.

Violations & Fines

Operating without the required site plan approval, municipal permit and CRC license, or inside a prohibited buffer, is enforced as a Chapter 550 zoning violation under § 550-284: a fine of $100 to $2,000, up to 90 days in jail, or both, with each day of continued operation a separate offense. Suspension, revocation or nonrenewal of the municipal permit, license or CRC authorization automatically revokes the zoning permit and the operation must cease under § 550-143.D.
