Rapid City bars medical cannabis establishments from operating within 1,000 feet of a school, and bars cultivation and manufacturing facilities from within 500 feet of a child care center, church, park or residential-zoned property, under Municipal Code § 17.50.105C.

C. Location of establishments. Medical cannabis establishments shall meet the location requirements of state law. In addition, medical cannabis establishments shall meet the following requirements: 1. A medical cannabis establishment shall not be permitted to operate within 1,000 feet of a public or private school. 2. Cultivation and manufacturing facilities shall not be permitted to operate within 500 feet of a child care center, church, public park, or property zoned as a residential district. 3. A dispensary may be permitted to operate within 500 feet of a child care center, church, public park, or a property zoned as a residential district only by obtaining a conditional use permit pursuant to § 17.54.030, and division D. below. 4. All measurements shall be made in a straight line, without regard to intervening structures or objects, from the nearest portion of the building or structure used as a part of the premises of a medical cannabis establishment to the nearest property line of the premises of those facilities or boundaries outlined above.

Full Breakdown

105, sets location buffers on top of whatever the state already requires for licensed medical cannabis establishments. 1 bars any medical cannabis establishment, cultivation facility, dispensary, manufacturing facility or testing facility from operating within 1,000 feet of a public or private school. 10 to include the LDR-1, LDR-2, MDR, HDR, MHR and PF districts). 030. 4 fixes how every one of these distances is measured, in a straight line, ignoring intervening structures or objects, from the nearest building or structure used as part of the cannabis establishment's premises to the nearest property line of the school, park, church, child care center or residential-zoned parcel.

105D requires every establishment to operate wholly inside an enclosed structure, submit an odor-control plan showing ventilation and filtration adequate to keep cannabis odor from reaching the property line, and maintain registration with the South Dakota Department of Health, since losing that state registration disqualifies the location as a permitted use in every zoning district.

Violations & Fines

Operating a medical cannabis establishment within 1,000 feet of a school, or a cultivation or manufacturing facility within 500 feet of a child care center, church, park or residential district without the conditional use permit § 17.50.105C.3 requires for dispensaries, disqualifies the location as a permitted use and can trigger revocation of any conditional use permit under § 17.50.105D.6.

Frequently Asked Questions

How close can a medical cannabis dispensary be to a school in Rapid City?
No closer than 1,000 feet. Rapid City Municipal Code § 17.50.105C.1 bars any medical cannabis establishment, including a dispensary, from operating within 1,000 feet of a public or private school, measured in a straight line to the nearest property line.
Can a cannabis cultivation facility operate near a residential neighborhood in Rapid City?
Not within 500 feet of property zoned residential. Section 17.50.105C.2 bars cultivation and manufacturing facilities from that 500-foot buffer around child care centers, churches, parks and residential districts, with no conditional use permit exception available for those two facility types.
Can a dispensary get an exception to the 500-foot buffer in Rapid City?
Yes, but only a dispensary. Section 17.50.105C.3 lets a dispensary operate within 500 feet of a child care center, church, park or residential district if it obtains a conditional use permit under § 17.54.030; cultivation and manufacturing facilities have no such path around the buffer.
