Florida MMTCs may deliver medical marijuana directly to qualified patients and caregivers anywhere in the state under FL §381.986 and OMMU rules. Miami-Dade cannot prohibit deliveries. Patients must hold a valid Medical Marijuana Use Registry ID; deliveries are tracked end-to-end by the state.
Under FL §381.986 and Florida Administrative Code 64ER, Medical Marijuana Treatment Centers may deliver products directly to qualified patients and registered caregivers using employee delivery vehicles. Patients verify identity with Medical Marijuana Use Registry ID and state-issued photo ID. Deliveries to dorms, parks, and schools are prohibited; private residences and offices are typical. Miami-Dade and constituent cities cannot ban or impose unique licensing on deliveries because the state preempts MMTC regulation. Recreational delivery does not exist as adult-use cannabis remains illegal in Florida after Amendment 3 failed in November 2024.
Operating outside OMMU rules can result in MMTC license suspension, criminal charges for non-licensed couriers, and seizure of product as contraband under FL §893.13.
