A retailer's storefront hours are also capped, running no earlier than 8:00 a.m. and no later than 9:00 p.m.

Every commercial cannabis permit runs through the Department of Conservation and Development, carries an initial five-year term, and can be renewed for additional five-year terms one at a time under Section 88-28.424.

Violations & Fines

Operating a commercial cannabis business without a Chapter 88-28 permit, or outside the zoning districts and location limits in Section 88-28.410, is prohibited outright under Section 88-28.204(a). An existing permit can be suspended or revoked under Section 88-28.602 for noncompliance with permit conditions, false statements in the application, loss of the underlying State license, or failure to pay required fees and deposits, following the same procedure used for conditional use permits under Article 26-2.20. Section 88-28.606 lets the county pursue any other remedy allowed by law.
