Brentwood, CA Cannabis Regulations: Dispensary Zoning (2026)

Brentwood Municipal Code Chapter 9.50, Cannabis Facilities and Cultivation, prohibits nearly all commercial cannabis activity citywide. Section 9.50.030 bans medicinal cannabis facilities in all zoning districts and bars the city from issuing any permit, license or entitlement for one; it also bars anyone from leasing property to, or working for, such a facility. Section 9.50.050 imposes the identical prohibition on non-medicinal (adult-use) cannabis facilities, again in every zoning district, with the same ban on leasing and employment. Section 9.50.060 separately bans origination or acceptance of cannabis deliveries anywhere in the city, with one narrow exception required by the state's Medicinal Cannabis Patients' Right of Access Act (Business and Professions Code Section 26321 et seq.): a retailer may deliver medicinal cannabis to a registered patient at a fixed address, but must first obtain a city business license if based outside Brentwood, may not deliver to schools, day care centers, youth centers, parks or food/beverage establishments, must securely package and label products, and must use delivery vehicles with GPS tracking, alarms and secure storage.

Section 9.50.040 permits only limited home cultivation: up to six living plants inside a private residence or a fully enclosed, secured accessory structure, with the property owner's written consent, compliance with Title 8 building code requirements, no gas products used in cultivation, and compliance with Health and Safety Code Section 11362.2(a)(3). Section 9.50.070 confirms the city will not issue any permit for activity requiring a state cannabis license.
