Duluth, MN Cannabis Regulations: Dispensary Zoning (2026)

Duluth regulates rather than prohibits cannabis retailers, using the time, place and manner authority the state legislature gave cities under Minn. 13(c): the City Council may restrict where and how a cannabis business operates but cannot ban the business outright. Every OCM state-licensed cannabis retail business must register with the city clerk before opening (§ 8A-4(a)), submitting an application under Chapter 31 with ownership details, addresses and a copy of the OCM preliminary license approval. Before the registration issues, the city runs a zoning pre-approval and preliminary compliance check, and within 30 days of receiving the state license application from OCM it must certify on an OCM form whether the proposed site complies with local zoning ordinances and, where relevant, the state fire and building codes (§ 8A-4(c)).

Two hard siting limits apply on top of that zoning sign-off: the location cannot sit in a prohibited alcohol license and sales area under § 8-68 (the chapter's minimum buffer requirement), and it must be a fixed, permanent premises in the city, since movable businesses are categorically ineligible for registration (§ 8A-4(n)(1)). Citywide, the number of active retail registrations cannot exceed one per 12,500 residents, with a waiting list once that cap is reached and first priority given to a new owner who buys a location that already carries a valid registration.

Registrations run one calendar year and must be renewed 30 to 60 days before expiration; the city can deny, suspend or revoke one for cause, with a right to reapply 12 months after a denial.
