Fayetteville, NC Cannabis Regulations: Dispensary Zoning (2026)

Ordinance S2024-017A added the Tobacco and Hemp Retail use, covering establishments whose principal business is tobacco or nicotine products, vapes, kratom, or any product containing THC above 0.3 percent. The use is permitted by right only in the NC, LC, and CC commercial districts. Section 30-4.C.4.i.12 requires 1,000 feet of separation, measured property line to property line, from any other such establishment and from schools, day care facilities, religious institutions, group homes, public parks, halfway houses, and residential rehabilitation support facilities. The ordinance limits a given property or building to one such use. The Eastern Band of Cherokee Indians operates a dispensary on sovereign tribal land in far western North Carolina under tribal law, outside both city and state jurisdiction.
