Full Breakdown
Franklin County Code § 155.085 adopts the use table as the basic land use regulation for the county, and it carries a MEDICINAL CANNABIS block with five rows. Reading the printed columns, the Dispensary row shows a P under PO, CL, CG and CH. The Safety compliance facility row shows a P under PO, CL, CG, CH, IC and IG. The Cultivator row shows a C under IC and a P under IG, with the footnote number 28 under AG. The Processor and Producer rows each show a C under IC and a P under IG. Residential districts carry no cannabis entry.
Section 155.088 explains the letters. A P means the use is permitted in that district subject only to site plan approval. A C means a conditional use requiring approval of the Board of Zoning Adjustments, under §§ 155.105 through 155.123. A number means the use is permitted subject to the condition printed under that number in § 155.089. Note (28) reads that only Tier I and Tier II medicinal cannabis cultivators may be permitted as a conditional use in the Agricultural (AG) District. Section 155.010 defines the tiers by indoor growth area: Tier I may not exceed 2,500 square feet, Tier II 10,000 square feet, Tier III 25,000 square feet and Tier IV 50,000 square feet. Tier III and Tier IV cultivators therefore have no agricultural-district path.
Zoning is only one test. The same chapter's definition of CANNABIS BUSINESS in § 155.010 bars a licensed cannabis business within 1,000 feet of an existing elementary or secondary school or a daycare center. The code also ties each use to licensure under KRS 218B, and it defines medicinal cannabis to exclude industrial hemp. The Planning Director or Zoning Enforcement Officer administers the chapter under § 155.025, and a building permit under § 155.026 is required before construction. The Franklin County code prints no ban or opt-out of cannabis businesses in this table; each use is placed in districts instead. Frankfort has its own code and zoning.
Violations & Fines
Operating a cannabis use in a district where the use table does not allow it, or without the Board of Zoning Adjustments approval a C requires, violates Chapter 155. Under § 155.999(A) the fine is not to exceed $250, and each day the violation continues is a separate offense. The Zoning Enforcement Officer can order the illegal use discontinued after written notice.
