Based on the authority of Cannabis Law section 131 as aforesaid, the Town of Hempstead does hereby declare that the licensure and establishment of a retail dispensary license and/or on-site consumption license under the provisions of article four of the New York State Cannabis Law authorizing the retail sale of adult-use cannabis to cannabis consumers shall not be applicable in the unincorporated portions of the Town of Hempstead.

Full Breakdown

Article IV of Chapter 121, adopted December 7, 2021 and effective February 28, 2022, exercises the opt-out authority New York gave every town, city, and village under Cannabis Law § 131. The Town Board declared that licensure and establishment of a retail dispensary license or on-site consumption license under Article 4 of the state Cannabis Law authorizing adult-use retail sales does not apply in the unincorporated portions of the Town, and formally requested that the state Cannabis Control Board prohibit such licenses within Town jurisdiction.

Because state law specifies that a town's opt-out law applies only to the area of the town outside any village within it, the incorporated villages inside Hempstead, such as Freeport, Rockville Centre, Garden City, Lynbrook, and Valley Stream, each separately decide their own opt-out status under their own local law; this Town ordinance has no effect inside those villages. The Town also separately banned retail sale of any product containing Delta-8 THC anywhere in the Town under § 121-20, adopted the same year, regardless of the opt-out question.

Any retail dispensary or consumption site that opens in the unincorporated Town despite the opt-out is treated as violating this article, with enforcement authority given jointly to Nassau County Police and the Department of Buildings.

Violations & Fines

Establishing a prohibited retail dispensary or on-site consumption license operation is a violation under § 121-21C punishable by appearance ticket returnable in Nassau County District Court, with a fine of $250 to $1,000 per occurrence and each day of violation a separate offense; the Town may also seek an injunction to shut the operation down.

Frequently Asked Questions

Can a licensed cannabis dispensary open in the Town of Hempstead?
No, not in the unincorporated Town. Section 121-21B declares that retail dispensary and on-site consumption licensure under the state Cannabis Law does not apply in the unincorporated Town, and the Town formally asked the state Cannabis Control Board to prohibit such licenses there.
Does the Hempstead dispensary opt-out apply inside villages like Freeport or Valley Stream?
No. State Cannabis Law § 131, quoted in § 121-21A, provides that a town's opt-out law applies only to the area of the town outside any village within it, so each incorporated village decides its own opt-out status separately.
What happens if a dispensary opens anyway in unincorporated Hempstead?
It is a violation under § 121-21C, punishable by a fine of $250 to $1,000 per occurrence with each day counted separately, and the Town can also sue for an injunction to close the operation.
