Miami Beach permits medical marijuana dispensaries (Medical Marijuana Treatment Centers) within its borders, restricted to zoning districts CD-2, C-PS2, and CD-1 under City Code Section 142-1502. Dispensaries must be located at least 500 feet from any private or public elementary, middle, or secondary school. Under Section 142-1503, dispensaries are prohibited from dispensing medical cannabis anywhere outside their licensed premises, and all cannabis sales activities must not be visible from outside the establishment. Only qualified medical cannabis patients with valid Florida Medical Marijuana Use Registry cards may purchase products. Miami-Dade County adopted Ordinance 16-67 (Article IXA of the Zoning Code) establishing the county-wide framework for medical marijuana dispensing locations. Dispensaries must also hold a valid state license from the Florida Department of Health Office of Medical Marijuana Use. The city conducted a moratorium process before establishing its final zoning regulations to study appropriate locations and buffer requirements.
Operating a dispensary outside approved zoning districts or without required licenses results in immediate closure and criminal prosecution. Dispensing within 500 feet of a school is a separate violation with enhanced penalties. Violations of the visibility requirement under Section 142-1503 can trigger Code Compliance action.
