The Texas Compassionate Use Program licenses only three dispensing organizations statewide: Compassionate Cultivation (Austin), Surterra Texas (Austin area), and Fluent/Cansortium Texas. These facilities serve patients with qualifying conditions (epilepsy, cancer, PTSD, autism, multiple sclerosis, Crohns, terminal illness) registered through the Compassionate Use Registry of Texas (CURT). Low-THC products (under 1% THC by weight) are dispensed by prescription only. Recreational dispensaries, smoke shops selling Delta-8/Delta-9 THC derivatives, and unlicensed CBD retailers operate in legal gray zones; Austin and Travis County have not adopted dispensary-specific zoning because commercial cannabis retail is not permitted. Hemp-derived CBD retailers must hold a TDSHS Consumable Hemp Product license.
