Section 115.28 of the Pompano Beach Code of Ordinances bans medical marijuana dispensing retail establishments within city limits. This prohibition applies to all zoning districts. Medical Marijuana Treatment Centers (MMTCs) as defined under FL Statute 381.986 are not authorized to operate in Pompano Beach. Although FL Amendment 3 (2024) legalized adult-use cannabis statewide, municipalities retain the authority to prohibit dispensary locations. Pompano Beach continues to enforce its ban. Residents must travel to neighboring municipalities for dispensary access.
