Somerville, MA Cannabis Regulations: Dispensary Zoning (2026)

Section 9.2.4 of the Somerville Zoning Ordinance sets the rules for where a cannabis business can operate. All cannabis enterprises, cultivation, product manufacturing, retail sales, research and testing, must comply with M.G.L. c. 94G and c. 94I and be licensed by both the Massachusetts Cannabis Control Commission and the Somerville Licensing Commission. Development review applications for any cannabis use are not considered complete until the applicant has secured a Community Host Agreement with the City, a local prerequisite layered on top of the state licensing process.

Cannabis Retail Sales carries the tightest locational standards in the use category. A retail site must be located at least 300 feet from any primary or secondary school or from Educational Services uses protected under M.G.L. c. 40A, Sec. 3, and the floor area of any retail cannabis store is capped at 10,000 square feet. The Zoning Board or Planning Board (whichever reviews the permit) may not approve a Special Permit for retail cannabis within 500 feet of a school without an affirmative finding that the use will not be detrimental to the nearby educational use, an extra hurdle beyond the ordinary special permit review criteria. On top of the education buffer findings, reviewers must weigh the capacity of the local street network for traffic and the location, visibility, and design of the store's principal entrance.

Across the district use tables in Articles 3 through 7, Cannabis Retail Sales is marked 'SP' (Special Permit required) in mixed-use and commercial districts and 'N' (not permitted) in the most restrictive residential columns; it is never a by-right ('P') use anywhere in the city. Cannabis Cultivation, Research & Development, and Testing Laboratory uses are permitted by right in industrial and commercial districts but excluded from residential columns.
