Somerville, MA Animal Ordinances: Pet Store Rules (2026)

Table 9.1.1 places Pet Store in the Retail Sales Use Categories and marks it SP (Special Permit) in the four Mid-Rise districts, High-Rise, Commercial Core, Commercial Industry, and Commercial Business, while marking it N (not permitted) in Neighborhood Residential, Urban Residential, Fabrication, Research & Development, and Civic. Zoning Ordinance §9.2.12.b.iv defines Pet Store as 'Uses that sell or otherwise provide household pets,' and expressly permits the ancillary sale of pet supplies alongside the animals. Nothing in the section conditions approval on the animals' source, so the Ordinance does not require an adoption-only model and does not bar a store from selling commercially sourced dogs or cats; the only zoning-specific standard is procedural.

Because Pet Store is grouped under the Consumer Goods retail category alongside Alcohol Sales and Firearms Sales as differently-regulated specific use types, a Pet Store applicant in an eligible district must still clear the citywide Special Permit review criteria at §15.2.1.e, and the review board layers on one additional, pet-store-specific finding: the building methods or techniques used for noise mitigation, to limit noise for other users of the building and for abutters. That single added criterion reflects that pet stores are commonly located inside mixed-use buildings with residential units above or beside them.

The provision falls within Article 9's Retail Sales Use Categories chapter, most recently amended by Ordinance 2025-15, effective June 26, 2025.
