Summary
Cambridge pet shops cannot sell commercially-bred dogs, cats or other animals; Municipal Code § 6.20.020 lets them offer only animals sourced from an animal care facility, a rescue nonprofit, or listed agricultural and breeder-carcass exceptions. Selling animals curbside or at flea markets is separately banned citywide under § 6.20.030.
A.A pet shop may offer for sale only those arachnids, birds, mammals, amphibians, or reptiles that the pet shop has obtained from or displays in cooperation with:1.An animal care facility, as defined in section 6.20.010 of this chapter; or2.An animal rescue organization, as defined in section 6.20.010 of this chapter; or3.An animal sold or displayed for agricultural uses; or4.Dead animals sold or displayed as breeder animals.B.Each pet shop shall maintain records sufficient to document the source of each arachnid, bird, mammal, amphibian, or reptile the pet shop acquires, for at least one year following the date of acquisition. Such records shall be made available, immediately upon request, to the Director of the Animal Commission, any Animal Control Officer, Police Officer and/or Sanitation Inspector or Code Enforcement Inspector detailed with the Public Health and Inspectional Services Departments.
Full Breakdown
020 of the Cambridge Municipal Code restricts every pet shop to offering for sale only arachnids, birds, mammals, amphibians or reptiles obtained from, or displayed in cooperation with, an animal care facility, an animal rescue organization, an animal sold or displayed for agricultural uses, or a dead animal sold or displayed as a breeder animal. That excludes animals bought from commercial breeders or brokers, the classic 'puppy mill' supply chain. Shops must keep records documenting the source of every animal they acquire for at least one year and make those records available immediately to the Director of the Animal Commission, an Animal Control Officer, a Police Officer or a Sanitation or Code Enforcement Inspector, and must post a sign on each cage naming the animal care facility or rescue organization the animal came from.
030 goes further and bans anyone, not just pet shops, from selling, exchanging, trading, bartering, leasing or displaying for a commercial purpose any arachnid, bird, mammal, amphibian or reptile on a roadside, public right-of-way, parkway, median, park, flea market, outdoor market or commercial parking lot, regardless of the property owner's permission; that section exempts animal-care-facility or rescue adoptions, state or county fair and 4-H exhibitions, agricultural animals, and breeder-carcass sales.
Violations & Fines
Selling an animal in violation of either the pet shop sourcing rule or the public-place sales ban is fined three hundred dollars per animal under § 6.20.050, and every animal sold or offered in violation counts as a separate offense, so a shop or seller moving several noncompliant animals faces the fine multiplied by each one. The Director of the Animal Commission, Animal Control Officers, Police Officers and Sanitation or Code Enforcement Inspectors all have authority to enforce the chapter.
