However, outdoor grows visible to neighbors or from public roads may trigger nuisance complaints handled by the Pima County Sheriff. Odor complaints are generally not actionable under state preemption. Cultivators may not sell homegrown cannabis -- personal use only. Medical marijuana patients under AMMA (Arizona Medical Marijuana Act) may also cultivate if they live more than 25 miles from a licensed dispensary.
Exceeding 6 plants per person or 12 per household is a petty offense for the first violation (civil penalty up to $300) under ARS 36-2853. Growing in an area accessible to minors or visible from public spaces may result in criminal charges. Sale of homegrown cannabis remains a felony under Arizona law.
