Arizona Proposition 207, the Smart and Safe Arizona Act, was approved by voters in November 2020 and took effect in January 2021. It permits adults 21 and older to possess up to 1 ounce of cannabis and grow up to 6 plants per person, with a maximum of 12 plants per household when 2 or more adults 21 and older reside there. Home-grown plants must be cultivated in an enclosed area with a lock that prevents access by persons under 21. The growing area must not be visible from a public place, meaning outdoor grows visible from streets, sidewalks, or neighboring properties are not permitted. The law preempts municipalities from prohibiting home cultivation, but local zoning can regulate the manner and location of growing. Sahuarita can require that cultivation be conducted indoors, in a greenhouse, or in a secured area that meets the enclosed and locked requirement. Rancho Sahuarita HOA CC&Rs may include provisions restricting cannabis cultivation, particularly outdoor growing, as private contractual obligations. Extraction of cannabis concentrates using volatile solvents at home is prohibited under state law. The Sahuarita Police Department enforces state cannabis laws, and cultivation beyond the permitted limits remains a criminal offense.
