Under Arizona Proposition 207, codified at ARS 36-2850 through 36-2866, adults 21 and older may cultivate up to six marijuana plants per person at their primary residence, with a household maximum of 12 plants regardless of the number of adults. Plants must be grown in an enclosed area equipped with a lock or security device preventing access by minors, and cultivation must not be visible from a public place without the use of binoculars or other optical aids. The Town of Oro Valley has not adopted supplemental cannabis cultivation ordinances beyond state law. However, HOA CC&Rs in most Oro Valley communities may impose additional restrictions on outdoor growing structures, odor, and visibility. Any accessory structure built for cultivation (greenhouse, shed) still requires a building permit if it meets the permitting threshold. Landlords may prohibit cultivation in lease agreements under ARS 36-2852(B). Odor from cannabis cultivation may be subject to nuisance complaints handled by Town code enforcement.
Exceeding the plant count is a petty offense for up to 12 plants over the limit, and a felony for more than 12 plants over the limit under ARS 36-2853. Providing marijuana to minors or growing without a locked enclosure can result in criminal charges.
