The Town Zoning Code prohibits the use of high-water-use non-native species in new development front yards and common areas. Existing homeowners are encouraged but not required to transition to native landscaping, though the Oro Valley Water Utility provides rebates and incentives for doing so.
Failure to meet native plant requirements in new development results in denial of landscape plan approval and potential stop-work orders. Removal of protected native plants without state permits violates ARS 3-904 and can result in felony charges and fines up to $100,000.
